Terms and Conditions

By using our Online Driver Improvement subscription service, you agree to the following Terms and Conditions

The following terms and conditions (“AGREEMENT”) are established between a 247drive customer (“STUDENT”) and 247drive (“COMPANY”).  STUDENT acknowledges and agrees to abide by the terms and conditions set forth here.  This AGREEMENT constitutes the entire contract between COMPANY and STUDENT.  No verbal assurances or promises not specifically enumerated within this AGREEMENT shall bind COMPANY or STUDENT.

Course Eligibility:

  • The age restriction for the Virginia Online Driver Improvement Course has been eliminated—all drivers regardless of age may attend a Virginia Online Driver Improvement Course.
  • Any customer holding a commercial driver’s license in Virginia or any other state is ineligible to attend a Virginia Online Driver Improvement Course.  This computer-based driver improvement clinic will not satisfy a driver improvement clinic requirement.  The customer must satisfactorily complete a clinic that provides classroom instruction.
  • Virginia driver improvement course (either online or in-classroom) does NOT fulfill the requirement for the 3 Exam Failures.

Driver’s license applicants who fail the knowledge exam or road skills test three times must successfully complete the applicable knowledge or in-vehicle component of a driver education course before they can take the examination a fourth time.  Classes taken at a driver improvement clinic do not meet this requirement.

Course Program & Agenda:

  • COMPANY’s Virginia Online Driver Improvement Course complies with Virginia DMV course content requirements.
  • COMPANY’s course meets and complies with Virginia DMV minimum 8-hour course length requirement.
  • STUDENT must spend a minimum of 8 hours in the course of study (as tracked and recorded by the website) and complete all training modules to be eligible to progress to the final exam.
  • STUDENT must successfully pass the final exam in order to receive credit for completing the course.

Course & Test Availability:

  • General access to COMPANY website (for the course, final exam, other general access) is available to the STUDENT 24 hours per day, 7 days per week, as applicable.
  • COMPANY is not responsible for service interruptions and delays caused by factors beyond its control including, but not limited to, issues related to power outages, connectivity, hosting, time keeping/tracking, issues arising from updates to site, or device used by STUDENT to access the website.
  • Any anticipated/planned interruption in service, such as routine maintenance of the network, will be announced on the website.
  • STUDENT may complete the course at his/her own pace and may log in/out as needed.  A STUDENT’s progress is tracked and recorded to ensure STUDENT meets the course’s 8 hours of instruction requirement as mandated by the Virginia Department of Motor Vehicles.
  • STUDENT’s access is subscription-based (10 days, 20 days, or 30 days).
  • STUDENT may purchase additional subscription access.  A subsequent purchase while a current subscription is active will result in the extended purchase being added to the remaining days in the current subscription.
  • STUDENT must complete the online course and take and successfully pass the final exam within subscription period.
  • Access will be revoked immediately following expiration of STUDENT’s course subscription regardless of STUDENT progress.
  • Course and final exam access may be extended (based on STUDENT’s selection of subscription period) with purchase of additional subscription after subscription access has been revoked.
    • Course access has a definitive start date/time (time of purchase) and end date/time (determined by access length of purchase).  Course and/or final exam access will NOT be extended or shifted to a different access period with a different access start/time and end date/time if STUDENT has not accessed any portion of the course.
  • If STUDENT’s purchase of the course subscription is disputed (dispute initiated through a bank), STUDENT’s access to the course materials and final exam will be revoked immediately pending the outcome of the dispute regardless of STUDENT progress.
    • STUDENT acknowledges and agrees that STUDENT’s access may be re-instated (at COMPANY’S discretion) after the dispute is resolved if any access time in the subscription remains prior to access expiration.

Hardware & Software Requirements:

  • STUDENT will require certain hardware and software to properly run website and online course content and final exam.
  • COMPANY’s web application is compatible with, and fully functional in all modern browsers that support CSS and JavaScript.

Course & Testing Fees & Online Purchases:

  • STUDENT agrees to pay subscription fee at the time of registration and prior to the starting the online course.
  • COMPANY assesses a $10.00 DMV processing fee for each Virginia Online Driver Improvement Course ordered to be paid by STUDENT at time of subscription purchase.  This processing fee is included in the subscription price.
  • COMPANY subscription fees may be discounted during promotional periods from time to time and are subject to change without notice.
  • COMPANY is not responsible for lost email transmissions directed at STUDENT by website or other means.  COMPANY will make reasonable attempts to send email transmissions to STUDENT upon request.
  • STUDENT is responsible for the payment of any add-on fees:
    • Fees apply to the audio read-along feature and for generating and mailing a certificate of completion.  The applicable fee applies to each add-on/certificate requested.
  • Mailed certificates will be shipped either via first class mail with the United States Postal Service or via expedited shipping service with UPS.  Shipping method is determined by STUDENT’s purchase.
  • COMPANY is not responsible for lost, damaged or misdirected mail of certificates of completion sent to STUDENT.
  • COMPANY does not guarantee delivery dates of mailed certificates. COMPANY is not responsible for shipping method’s time of shipment and delivery.

STUDENT Data:

  • As part of the registration process STUDENT will be required to furnish certain personal information including, but not limited to, full name, address, telephone number, email address, date of birth, driver’s license number, billing and payment information (including credit card information).
  • NOTE:  A court now has the option to award Safe Driving Points as part of a STUDENT’s mandate to complete a court-ordered driver improvement course.  STUDENT must indicate at the time of registration whether or not the court will award Safe Driving Points; STUDENT must provide to COMPANY court documentation that authorizes the award of Safe Driving Points.  STUDENT must upload that documentation during the registration process.
  • STUDENT acknowledges that the information provided is true and accurate for purposes of receiving credit for course upon completion of the course of study and the successful passing the final exam.
  • IMPORTANT NOTICE:  If STUDENT enters his/her date of birth and/or customer number (driver’s license number) incorrectly at the time of registration, COMPANY will not transmit course completion to the DMV and the course completion will not be posted to STUDENT’s driving record.  COMPANY will notify STUDENT via email to make corrections before course completion will be transmitted to the DMV and the certificate of completion will be generated and issued to the STUDENT.

Bypass Warning & Disqualification from Program:

  • STUDENT acknowledges that it is unlawful to provide false information and/or to bypass or attempt to bypass COMPANY’s state-licensed online course.
  • STUDENT agrees that s/he will solely complete the online course of study, module review quizzes, and final exam—no other person shall aid STUDENT in taking and/or completing the course of study, module review quizzes, or the final exam.
  • STUDENT agrees s/he will not utilize any other form of study aid to complete the online course of study, module review quizzes, or the final exam.
  • STUDENT agrees that STUDENT’s willful attempt to bypass security measures will result in STUDENT’s immediate disqualification.
  • STUDENT acknowledges that if COMPANY discovers STUDENT has willfully provided falsified information or disregards any of the terms and conditions of this AGREEMENT or cheats on any portion of the online course, module review quizzes or final exam, STUDENT shall immediately be disqualified from the program.
  • STUDENT’s disqualification from the online course and/or final exam shall result in a STUDENT forfeiting any subscription and/or mailed certificate of completion fee(s) already paid, forfeiting the opportunity to complete the online course of study and take the final exam, and shall forever bar STUDENT from participating in any future course of study and/or exam the COMPANY offers.

Validation:

  • STUDENT shall provide answers to personal questions during registration process that will be used to validate STUDENT’s identity.
  • STUDENT’s failure to correctly answer all personal security questions will place STUDENT’s account in a 1-hour time out.  STUDENT will not be able to access his/her account until the time out passes.

Final Exam:

  • The course’s final exam is administered entirely online.
  • STUDENT will be eligible to take the final exam upon completing the online course of study.
  • It is the STUDENT’s responsibility to ensure sufficient time exists to complete the online course of study, to successfully pass the final exam, and to return any required paperwork to the court of record or the DMV.
  • The final exam will be entirely computer-based on our website.  There is no open-book testing.
  • STUDENT must achieve a score of 80% or better on the final exam to receive credit for the course and receive a certificate of completion.
  • Final exam testing may be repeated until STUDENT passes the test.  However, STUDENT can only test once every 24 hours.  Final exam testing may only be performed while STUDENT’s subscription is valid and not expired or revoked.

Certificate of Completion:

  • STUDENT must complete all requirements (course completion and satisfactory passing of the final exam) set forth in this AGREEMENT to receive a certificate of completion.
  • COMPANY shall not issue a certificate of completion to any STUDENT that has not complied with requirements set forth in this AGREEMENT.
  • Upon successfully passing the final exam STUDENT will receive email notification with a downloadable version (PDF) of the certificate of completion.  This downloadable version is considered an ORIGINAL document that is accepted by the courts.
    • COMPANY will email the downloadable version (PDF) of the certificate of completion ONLY to the STUDENT’s email address provided in the STUDENT’s profile.
    • COMPANY will mail any certificate(s) of completion to STUDENT for orders that include the purchase(s) of a printed certificate of completion.  The certificate(s) will be mailed ONLY to the STUDENT’s address provided in the STUDENT’s profile.
    • Mailed certificates will be shipped either via first class mail with the United States Postal Service or via expedited shipping service with UPS.  Shipping method is determined by STUDENT’s purchase.
    • COMPANY is not responsible for shipping method’s time of shipment and delivery.
    • STUDENT is responsible for the payment of any applicable fees for the mailed certificate of completion.
    • COMPANY is not responsible for lost, damaged or misdirected mail of certificates of completion sent to STUDENT.
  • It is the STUDENT’s responsibility to forward the certificate of completion to the competent authority (i.e., court, DMV, insurance company, etc.).

Notification to DMV:

  • COMPANY will electronically submit notification to DMV within 24 hours of STUDENT’s completing the course and passing the final exam.

Refund Policy:

  • STUDENT satisfaction is of great importance.
  • Eligibility:
    • STUDENT is eligible to request a refund of the purchase within 5 days of completing the purchase.
    • STUDENT must make the refund request in writing via email.
    • STUDENT must not have violated COMPANY’s Terms and Conditions.
  • Ineligibility:
    • No refunds will be issued for requests made after 5 days of the purchase.
    • No refunds will be issued if STUDENT has passed the final exam.
    • No refunds will be issued for any mailed certificate that has been mailed to the STUDENT.
    • No refunds will be issued to any STUDENT that has disputed a purchase.
  • STUDENT acknowledges and agrees that any valid refund request of a subscription fee and/or mailed certificate, subject to the terms and conditions of the refund policy, will result in the STUDENT’s immediate revocation of access to the online course and final exam.
  • Allow up to 30 days for refunds to be issued.

Privacy Policy:

  • For complete details, please refer to COMPANY’s Privacy Policy.
  • STUDENT agrees to COMPANY collecting information and disclosure of information as described in the Privacy Policy.

Liability Waiver:

  • COMPANY does not represent or promise that taking any of its courses, or successfully passing any of its tests, will prevent STUDENT from violating traffic and/or criminal laws in the future, becoming involved in traffic crashes, or being otherwise affected by misfortune.
  • STUDENT is solely responsible for his/her own driving activities and their intended and unintended consequences.
  • STUDENT (including his/her heirs, representatives and assigns) releases and forever discharges and agrees to save and hold harmless and indemnify COMPANY and its directors, instructors and related personnel of and from all liability claims, demands, causes of action and possible claims whatsoever, arising out of or related to any loss, damage or injury that may be sustained by persons or property, or resulting directly or indirectly from any training received or offered by COMPANY from any cause whatsoever including negligence of any of the foregoing releases.

Surveys & Testimonials:

  • COMPANY may request information from STUDENT via surveys.  STUDENT participation in these surveys is voluntary.
  • COMPANY may use survey information for monitoring and/or improving the use and satisfaction of COMPANY website and for statistical purposes.
  • COMPANY may also use survey information for customer testimonial.  STUDENT may opt out of testimonial participation and submission.
  • By submitting answers to the survey STUDENT gives the COMPANY permission to reprint, reproduce or use answers for customer testimonial, under the following terms and conditions as listed below:
    • STUDENT acknowledges and agrees that COMPANY shall have the right to publish STUDENT answers, in whole or in part, in any format or media, whether now known or hereafter developed;
    • COMPANY may reprint, reproduce or use STUDENT answers at COMPANY’s discretion and without compensation;
    • STUDENT agrees to allow COMPANY to display STUDENT’s answers with STUDENT’s first name, last name or any derivative thereof and city/state;
    • COMPANY’s right to use STUDENT answers is perpetual and may be assigned; and
    • STUDENT solely composed and submitted the answers.

Ownership:

  • All rights, titles, and interests, including all federal copyrights, associated trademarks, and other intellection property rights on the COMPANY’s website are either owned by COMPANY or the party that has provided the content.  Additionally, pictures, graphics, names, images, logos and icons identifying either COMPANY’s or other content providers’ products and services are proprietary marks of COMPANY or other content providers.
  • Except as provided in the Limited License section herein, nothing contained herein shall be construed as conferring any license or right, either by implication or otherwise, under copyright, trademark or other intellectual property rights.

Limited License and Restrictions Governing Use:

  • COMPANY hereby grants STUDENT a non-exclusive, non-transferable, limited license to participate, view and complete a traffic safety course of instruction on this website and to download and/or print insignificant portions of course materials retrieved from this website provided:
    • such materials are used only to complete a course of instruction for which STUDENT is enrolled on this website; and
    • STUDENT or others visiting the site, do not remove or obscure the copyright notice or other notices or attempt to alter, for whatever purposes, the materials included on this website.
  • Except as expressly provided above, no part of this website, including, but not limited to materials retrieved from it and the underlying source code, may be reproduced, republished, copied, transmitted, or distributed in any form or by any means, without the express written permission of COMPANY.

Entire Agreement:

  • STUDENT acknowledges and agrees to the Terms and Conditions and Privacy Policy set forth herein.  Any notices contained on this website constitute the entire agreement with respect to STUDENT’s access to and use of this website.  Any provision of these Terms and Conditions and Privacy Policy construed as unlawful, void or unenforceable shall be deemed severable from the remaining provisions and shall not affect the validity and enforceability of the surviving provisions.
